1. Who sells
OMU SAS is the seller of record for purchases made in apps you build and publish on OhMyUnicorn. By enabling payments in an app you license OMU SAS to sell access to it and you agree to these terms.
2. Your share
For each sale, your share is worked out in four steps.
- The price the buyer paid.
- Minus the tax OMU SAS owes for the buyer's country.
- Minus the payment processing fee.
- Minus the OhMyUnicorn fee, 10% of the price excluding tax.
What is left is your share. It is kept in euros, at the exchange rate our payment processor settled.
3. Release policy
Your share becomes available 14 days after the sale.
10% of it is held back as a reserve. That reserve becomes available 120 days after the sale.
OMU SAS may extend a hold for a specific sale or app when it sees signs of fraud, a dispute or a breach of these terms. We will tell you why.
4. Refunds and disputes
If a buyer is refunded or wins a card dispute, the matching share is removed, including after you converted or withdrew it.
If that leaves a negative amount, it is recovered from your future earnings, and you cannot convert or withdraw while it is negative.
Payment dispute fees are borne by OMU SAS.
5. Credits option
When this option is open, you can turn available earnings into OhMyUnicorn credits at a bonus, currently +50%. Purchases you make in your own apps convert without the bonus.
Converting is one-way and final. Credits are usable only for OhMyUnicorn services, have no cash value, and cannot be transferred or refunded, except where the law requires otherwise.
Converting is optional. You can always ask for a bank payout instead (see 6).
6. Withdrawal
Self-service bank withdrawals are not available yet and have no set date. You can request a bank payout of your available earnings at any time; OMU SAS will contact you to complete it. A payout needs:
- A minimum available amount of EUR 50.
- A one-time identity verification run by our payment processor Stripe: identity document, address, bank details, tax number where required, and possibly further checks later.
- Acceptance of Stripe's Connected Account Agreement, and any tax withholding the law requires.
Payments are sent by Stripe to your bank. Earnings from purchases you make in your own apps can be converted to credits but are not paid out to a bank.
7. Your taxes
Earnings, including earnings you convert into credits, can be taxable income for you. You are responsible for declaring them.
OMU SAS sends you a yearly statement of your earnings and may report them to the tax authorities when the law requires it.
8. What apps may not sell
Payments are not allowed for:
- Prohibited or illegal goods and services.
- Gambling.
- Regulated financial, health or insurance products.
- Adult content.
- Anything that breaks card network rules.
OMU SAS may suspend payments for an app that does, and withhold the related earnings while it investigates.
9. Changes and law
OMU SAS may update these terms with 30 days notice for changes that reduce your share. The version you accepted applies to earnings you have already made.
These terms are governed by French law. If you act as a consumer you keep the protections of the law of your country of residence.
